Many people in Jammu and Kashmir find their bank account suddenly frozen, often because money linked to an online-fraud complaint passed through it, sometimes without their knowledge. A freeze is not a finding that you committed fraud, but it can stop your business or salary payments until it is resolved.
Why accounts get frozen
When a victim reports online fraud — through the national cyber-crime portal, the 1930 helpline or a police station — the police trace where the money went and ask the banks to put a hold or debit freeze on the receiving accounts. Accounts several steps down the chain, including those of shopkeepers and traders who received payments in good faith, are often frozen too.
Step 1: Find out who froze it and why
- Write to your bank asking for the police station or cyber cell, the complaint or acknowledgement number, the date and the amount on hold.
- Check whether the whole account is frozen or only the disputed amount.
- Gather proof of the transaction: invoices, chats, delivery records, who paid you and why.
Step 2: Approach the investigating agency
Where the money was received in a genuine transaction, placing the documents before the investigating officer, in writing, is often the quickest route to having the freeze lifted or limited to the disputed amount.
Step 3: Court remedies
Freezing a bank account is a seizure under Section 106 BNSS (earlier Section 102 CrPC), and the police must report it to the Magistrate. Several High Courts have released accounts where this was not done, or where the whole account was frozen when only a small amount was in dispute.
Depending on the facts, an application can be made to the jurisdictional Magistrate for release, or a writ petition can be filed in the High Court at Jammu. Courts have often directed that the account be unfrozen while the disputed amount stays on hold until the case is decided.
Frequently asked questions
My account was frozen but I did nothing wrong. Am I an accused?
Not necessarily. Many accounts are frozen only because money passed through them. Being frozen does not by itself make you an accused, but you should keep your transaction records ready.
Can the whole account be frozen for a small disputed amount?
Courts have repeatedly found that freezing an entire account for a small disputed sum is disproportionate, and have limited the hold to the disputed amount.
I was the victim of a UPI fraud. What should I do?
Report it immediately on the 1930 helpline or the national cyber-crime reporting portal, and to the cyber police station. Speed matters, because funds can be frozen before they are withdrawn.
